When you come to GCM Legal for your Road Accident Fund (“RAF”) Claim, we handle the submission of your Claim to the RAF; we will issue a summons and sue the RAF for you; and, where appropriate, we will negotiate settlement with the RAF.

Submit RAF Claim

We will prepare your claim and submit it to the RAF.

We gather all the relevant information from you regarding the accident.  We will also arrange Medico-legal Report necessary.

We can also take over your claim if you have already submitted your claim to the RAF, which will give you a chance at the best possible result.

 

Sue the RAF

It is often necessary to sue the RAF to get the correct settlement out of them.

After submitting your claim to the RAF, it is common for the RAF to offer to settle a claim with an unreasonably low amount; especially when it comes to general damages (pain and suffering).

GCM Legal will sue the RAF on your behalf if the offer that the RAF makes is not acceptable.

 

Negotiate Settlement with RAF

At various stages after Submitting a claim, the topic of settling the claim will come up.

It is very important to have an experienced attorney on your side when this happens.

As mentioned above, the RAF will often make low or unacceptable offers in the early stages.

GCM Legal will use its extensive experience to negotiate with the RAF on your behalf.

We to negotiate for the best settlemetn we can, and if settlement does not yeild the reasons required we will go to Court on your behlaf.

 Below is a list of the documents we would eventually need to start your Claim with the RAF but often additional document / reports are needed to make stregnthen your claim, which we will help put together for you.

Documentation that will form part of your RAF Claim

  • Copy of ID Document of the person claiming from the RAF.
  • Vouchers and documents in support of amounts claimed.
  • Death Certificate; Inquest Report; Charge Sheet (if applicable).
  • Proof of relationship to deceased (if applicable).
  • Supporting documentation for Income lost due to absence from work (e.g. Payslips; Tax Return; Bank Statements; etc.) (if applicable).
  • An affidavit setting out the full particulars of the accident.
  • A medical report by the treating doctor.
  • Statements of witnesses.
  • Police reports.
  • Hospital and medical records.
